IL HB3960

Amends the Abused and Neglected Child Reporting Act to expand the definition of "child" to include those emancipated by court order under the Emancipation of Minors Act, in addition to those emancipated by marriage or military service.

Requires the Department of Children and Family Services to videotape and audiotape all victim-sensitive interviews of children alleged to be abused, with recording beginning at the start and continuing without interruption until the interview concludes.

Mandates that the Department preserve all videotapes, audiotapes, written notes, and reports from victim-sensitive interviews until all legal judgments are final and all direct and habeas corpus appeals are exhausted or barred by law.

Restricts access to interview recordings to specified parties including judges, attorneys, State's Attorneys, psychologists, psychiatrists, social workers, doctors, parents, probation/parole officers, guardians ad litem, and those involved in criminal, abuse, custody, or adoption proceedings.

Entitles non-offending caretakers to receive copies of interview materials within 30 days upon written request, with the Department bearing all associated copying costs and required to provide notice of this right to all parties.
