HB4088 - Illinois Accurate Government Records Act

• Establishes comprehensive privacy protections requiring state and local agencies to limit collection, maintenance, and dissemination of personal records to information relevant and necessary for authorized agency purposes.

• Grants individuals the right to access their personal records within 10 working days (extendable 20 days) and to request corrections within 30 days, with agency appeal procedures for denied amendment requests.

• Prohibits agencies from disclosing personal records without written consent except for authorized routine uses, law enforcement activities, Freedom of Information Act requests, court orders, and other specified circumstances.

• Requires agencies to maintain accurate, complete, and timely records; publish notices describing their record systems; establish security safeguards; and train employees on privacy requirements.

• Provides individuals with civil remedies including court orders to disclose or correct records, injunctive relief, and damages of at least $1,000 plus attorney's fees when agencies knowingly or intentionally violate the Act.
