HB4124 Summary

• Amends Section 24-1.6 of the Criminal Code to remove street gang membership as an aggravating factor for aggravated unlawful use of a weapon charges.

• Creates new Section 24-1.8 establishing the offense of "unlawful possession of a firearm by a street gang member" as a Class 2 felony with mandatory imprisonment of 3-10 years.

• Mandates minimum sentences with no probation, periodic imprisonment, or conditional discharge for street gang members in possession of loaded firearms or firearms with ammunition.

• Amends the Unified Code of Corrections Section 5-5-3 to add unlawful firearm possession by street gang members (when loaded or containing ammunition) to offenses prohibiting probation and requiring minimum imprisonment sentences.

• Takes effect upon becoming law.
