IL HB4196

Amends the Code of Civil Procedure by adding Section 2-418 to provide additional protections for active military personnel beyond the federal Servicemembers Civil Relief Act.

Requires creditors to suspend and defer activity in actions against defendants who are on active military duty stationed outside Illinois.

Mandates courts stay proceedings in creditor actions once it is determined the defendant is on active out-of-state military duty until the person is discharged or no longer stationed out of State.

Defines "person on active military duty" as anyone currently serving on active duty in the U.S. Armed Forces, Illinois National Guard, or any reserve component of the Armed Forces.
