HB4222 - Substance Abuse and Crime Prevention Act

• Creates mandatory probation (instead of incarceration) for individuals convicted of nonviolent drug possession offenses, with required participation in drug treatment programs as a condition of probation.

• Courts may impose additional probation conditions including vocational training, family counseling, literacy training, or community service, but cannot impose incarceration as an additional condition.

• Allows judges to require defendants who are reasonably able to contribute financially to the cost of their drug treatment placement.

• Permits dismissal of charges upon successful completion of drug treatment and substantial compliance with probation conditions, with the arrest deemed never to have occurred (with limited exceptions for firearm restrictions and public office disclosures).

• Exempts defendants from this probation requirement if they have prior violent crime convictions, refuse treatment, possess drugs while armed with a firearm, or fail treatment twice after participating in two separate treatment courses.
