IL HB5092

Amends the Criminal Code of 1961 to classify aggravated criminal sexual assault involving delivery of controlled substances without consent, by threat, or by deception as a Class X felony with a mandatory 10-year sentence enhancement.

Adds controlled substance delivery (by injection, inhalation, ingestion, transfer of possession, or any other means) as an aggravating circumstance for criminal sexual assault under subsection (a)(7).

Permits courts to impose an additional sentence of up to 25 years if a sexually transmitted disease was transmitted from the accused to the victim during commission of the offense.

Maintains existing sentencing structures for other aggravating circumstances, including 15 years for firearm possession, 20 years for firearm discharge, and 25 years to life for firearm discharge causing great bodily harm or death.

Requires natural life imprisonment for second or subsequent convictions of aggravated criminal sexual assault or related offenses.
