Bill Summary: HB5115 - Prescription Drug Repository Program Act

• Establishes a prescription drug repository program through the Department of Public Health allowing healthcare facilities (assisted living, hospice, rehabilitation, long-term care) to donate unused prescription drugs and supplies to eligible individuals through participating pharmacies.

• Sets requirements for donated drugs including: original unopened packaging, expiration date at least 6 months from donation, pharmacist inspection for adulteration or misbranding, and valid prescriber authorization for eligible recipients.

• Prohibits resale of donated drugs and allows pharmacies to charge a handling fee (amount to be determined by Department); participation by pharmacies and pharmacists is voluntary.

• Provides civil and criminal immunity to drug manufacturers and pharmacists for donation, acceptance, or dispensing of drugs under the program, except in cases of willful and wanton misconduct.

• Amends existing pharmacy and controlled substance laws to exempt persons engaged in donating, accepting, or packaging drugs under the Repository Program from provisions that would otherwise regulate or prohibit such activities.
