HB5222 Summary

• Amends the Department of Professional Regulation Law to authorize the Department of Financial and Professional Regulation to expunge disciplinary offenses from licensees' records if the offense is administrative in nature or unrelated to patient care for health care professionals.

• Eligible offenses for expungement include failure to complete continuing education, failure to maintain required licenses or certifications, failure to renew a license timely, failure to report a practice location, and other administrative offenses prescribed by rule.

• Licensees may apply for expungement only if more than 3 years have passed since the disciplinary offense was adjudicated and the licensee has not been previously or subsequently disciplined for a similar or more serious offense under the same licensing Act.

• Expungement requests must be submitted to and considered by the appropriate licensing Board according to requirements established by the Department through administrative rules.
