IL HB5327

Requires that all determinations by a technician that a motor vehicle violated automated traffic law (red light) regulations must be reviewed and approved by a sworn law enforcement officer before a violation notice is issued.

Adds new information requirements to red light violation notices, including the technician's name and business address, the date and time of the technician's determination, and identification of the sworn officer who approved the violation.

Establishes an additional defense to red light violations if the person issued the violation demonstrates by clear and convincing evidence that they were not operating the vehicle at the time of the violation, with any supporting written documents verified by certification.

Applies only to Cook, DuPage, Kane, Lake, Madison, McHenry, St. Clair, and Will counties and municipalities within those counties.

Caps traffic education program fees at $25, with exemptions for low-income individuals eligible for federal or Illinois earned income tax credits.
