HB5414 Summary

• Allows first-time juvenile offenders to receive probation without judgment entry for probationable felonies including theft, retail theft, forgery, prostitution, possession/delivery of cannabis or controlled substances, and related drug offenses, with consent of both the minor and State's Attorney.

• Excludes minors with prior felony convictions or those guilty of violent offenses (including offenses involving bodily harm, sexual conduct, domestic violence, firearm possession, or driving under the influence) from this probation option.

• Requires minimum 24-month probation period with ability to dismiss charges and discharge minor upon successful completion of probation terms and conditions.

• Permits minors age 17 or older whose probation is successfully completed to petition for expungement of law enforcement and juvenile court records relating to the offense.

• Effective immediately upon passage.
