HB5746 Summary

• Amends Illinois Vehicle Code Section 11-208.6 to regulate automated traffic law enforcement systems (red light cameras) in Cook, DuPage, Kane, Lake, Madison, McHenry, St. Clair, and Will counties and their municipalities.

• Prohibits automated systems from recording vehicle speeds; regulates use of red light cameras by requiring clear images of violations with time, date, and location displayed.

• Imposes civil penalties not exceeding $100 (plus up to $100 additional penalty for non-payment) or traffic education program completion; violations do not appear on driving records and Secretary of State may suspend driving privileges after 5 unpaid violations.

• Establishes "back-door referendum" requirements: counties and municipalities that adopt red light camera ordinances must publish notice and allow registered voters (10% threshold) to petition for referendum within 30 days to approve or reject the fines and penalties.

• Requires traffic education program fees not to exceed $25, with exemptions for low-income individuals with earned income tax credits; allows vehicle owners to submit affidavits if another person had control of the vehicle at time of violation.
