HB6061 Summary

• Requires accident and health insurance policies amended, delivered, issued, or renewed after July 1, 2010 to provide coverage for maternity care, including prenatal care, delivery, complications of pregnancy, and related physician and hospital services.

• Mandates that financial requirements (deductibles, copayments, coinsurance, limits) and treatment limitations for maternity benefits be no more restrictive than those applied to substantially all other hospital and medical benefits covered by the policy.

• Prohibits insurers from refusing coverage, limiting coverage, or charging different rates based solely on pregnancy status or previous cesarean delivery, and prohibits pregnancy-related preexisting condition exclusions.

• Bans gender-based rating in premium determination and underwriting decisions for all accident and health insurance policies issued in Illinois.

• Extends the same maternity coverage requirements and protections to health maintenance organization contracts and evidence of coverage, and requires HMOs to comply with gender rating prohibitions under the Illinois Insurance Code.
