School buses must contain either an operating cellular phone or two-way radio (not just two-way radio) while the driver is in possession of the bus, with the device turned on and adjusted to alert the driver of incoming communications.

School bus drivers are prohibited from using a cellular phone while operating a bus with passengers, except for emergency communications, mechanical breakdowns, or contacting school authorities about bus operation or passenger welfare and safety issues.

Violations of the cellular phone prohibition while operating a bus are a petty offense punishable by a fine of $100 to $250.

School district policies must require drivers to test the cellular phone or two-way radio before operating the bus and to walk to the rear of the bus at the end of each route to check for left-behind passengers.

The Act takes effect immediately upon becoming law.
