HB6149: Tobacco Sales At Health Care Institutions Prohibition Act

• Prohibits health care institutions (hospitals, clinics, pharmacies, drug stores, doctors' and dentists' offices) from selling tobacco products effective January 1, 2011.

• Extends the prohibition to retail establishments that operate or contain a health care institution within them, such as pharmacies or drug stores.

• Establishes penalties for violations: $200 for first offense, $700 for second offense within 24 months, and $1,000 for third or subsequent offenses within 24 months; each calendar day of operation in violation constitutes a separate violation.

• Creates the Tobacco Products Education Fund in the State treasury to receive all fines and fees collected under the Act, with funds directed by the Department of Public Health toward enforcement and educational programs on tobacco's harmful effects.

• Permits the Illinois Department of Public Health or other agencies to suspend or revoke licenses or permits for repeated violations of the Act.
