HB6910 Summary

• Extends New Vehicle Buyer Protection Act to include new motorized wheelchairs purchased or leased for at least one year, providing the same consumer protections available to vehicle buyers.

• Manufacturers must replace or accept return of nonconforming motorized wheelchairs and provide full refund of purchase price or lease cost (minus reasonable wear allowance) if unable to repair after reasonable attempts.

• Presumes reasonable repair attempts when same nonconformity has been repaired 4 or more times during warranty period or wheelchair has been out of service 30+ business days for repairs.

• Specifies refunds must be paid to consumer and to medical assistance program administrator, Medicare administrator, private insurers, or other lien holders as their interests appear.

• Applies protections to motorized wheelchairs with model year 2012 and thereafter; takes effect immediately.
