IL SB1349

Amends the Illinois Public Aid Code Section 5-4 to require the Department of Human Services to include information about assistance available to community spouses in written notifications sent to institutionalized spouses receiving medical assistance.

Department must notify institutionalized spouses and community spouses of changes in income and resource treatment, including provisions for protecting community spouse income and permitting resource transfers.

Notification must be in language likely to be easily understood by recipients and must include specific information about community spouse protections under federal law.

Department must reassess medical assistance eligibility for recipients based on changes from the federal Medicare Catastrophic Coverage Act of 1988, whether or not reassessment is requested.

Act takes effect immediately upon becoming law.
