IL SB2552

Requires all pharmacies that dispense drugs to maintain a representative assortment of drugs at all times to meet patients' pharmaceutical needs.

Establishes a duty for pharmacies to deliver lawfully prescribed drugs or devices to patients in a timely manner, or provide a therapeutically equivalent alternative.

Exempts pharmacies from this duty in limited circumstances, including when the pharmacist identifies clinical safety concerns, during national or state emergencies, due to lack of specialized equipment, for potentially fraudulent prescriptions, or when drugs are unavailable despite good faith efforts.

Requires pharmacies unable to fill a prescription to offer alternatives such as contacting the prescriber, returning the unfilled prescription to the patient upon request, or transferring prescription information to another pharmacy.

Establishes grounds for discipline including destruction or refusal to return unfilled lawful prescriptions, patient privacy violations, unlawful discrimination, patient intimidation or harassment, and failure to comply with these requirements; preempts prior Department rules regarding emergency contraception dispensing.
