Department of Financial and Professional Regulation may subpoena dental records of patients upon Board chairperson determination of reasonable cause that a violation of disciplinary grounds has occurred or is occurring.

Board and Department may subpoena hospital, medical, or dental records in mandatory report cases involving death or permanent bodily injury without patient consent, with all records kept confidential under medical study protections.

Patient records are admissible in disciplinary hearings before the Secretary, Board, or hearing officer when necessary to substantiate grounds for discipline against licensed dentists or dental hygienists.

Department may disclose investigation information and documents to federal, state, or local law enforcement agencies pursuant to subpoena in criminal investigations or to dental licensing authorities of other states for disciplinary proceedings.

Department must reimburse fees and mileage associated with subpoena power according to procedures prescribed for civil judicial cases.
