SB3034 Summary

• Adds new Section 355.3 to the Illinois Insurance Code prohibiting insurers from requiring dentists to provide services at insurer-set fees unless those services are covered under the policyholder agreement.

• Defines "covered services" as services reimbursed according to usual and customary fees under the applicable policyholder agreement, and establishes that usual and customary fees must be consistent with average rates in the geographic area where services are provided.

• Grants the Director of Insurance authority to enforce the noncovered dental services provisions through rulemaking, cease and desist orders, fines, and other penalties.

• Applies the new dental services requirements to all dental insurance policies issued, delivered, amended, or renewed on or after the effective date under the Illinois Insurance Code, Dental Service Plan Act, Health Maintenance Organization Act, Limited Health Service Organization Act, and Voluntary Health Services Plans Act.

• Effective immediately upon becoming law.
