IL SB3644

Amends the Illinois Wage Payment and Collection Act to exclude real estate licensees from the definition of "employee" when performing licensed activities.

Adds new penalty provision requiring employers who fail to pay all earned commissions to separated employees within the required timeframe to pay 3 times the unpaid commission amount plus court costs, attorney's fees, and other associated litigation costs.

Maintains existing criminal penalty of Class C misdemeanor for employers who willfully refuse to pay wages, final compensation, or wage supplements with intent to defraud or harass employees.

Preserves existing civil penalty structure requiring employers to pay 1% per calendar day up to twice the unpaid wages if they fail to comply with Director of Labor demands or court orders within 15 days, plus 20% liability to the Department of Labor.
