• Modifies the definition of ignition interlock device to specify it analyzes the driver's breath (rather than blood) alcohol to prevent vehicle starting.

• Establishes automatic issuance of Monitoring Device Driving Permits (MDDP) to first-time DUI offenders upon notice of statutory summary suspension, with the option to decline the permit in writing.

• Requires MDDP holders to install and maintain a breath alcohol ignition interlock device (BAIID) within 14 days, with a maximum administration fee of $30 per month, and permits limited exemptions for farm tractors and employer-owned vehicles.

• Creates the Indigent BAIID Fund supported by a 5% surcharge on ignition interlock device revenues to provide free installation and monitoring for indigent MDDP holders.

• Imposes escalating penalties for MDDP violations including 3-month suspension extensions for each violation, vehicle impoundment after three violations, and vehicle seizure/forfeiture after four violations.
