IL SB3961

Amends the Criminal Code of 1961 to establish aggravated battery involving torture as a Class X felony when the offense causes great bodily harm, permanent disability, or disfigurement.

Defines torture for purposes of this statute as the infliction of or subjection to extreme physical pain, motivated by an intent to increase or prolong the victim's pain, suffering, or agony.

The torture-based aggravated battery provision applies only when the battery is intentional and meets the torture definition, creating a new sentencing tier above existing Class 1 felony provisions.

Takes effect immediately upon becoming law.
