HB1101 Summary

• Amends the State Property Control Act to redefine "surplus real property" as property unused for at least 3 years with no foreseeable use in the next 3 years, unused for at least 6 years, or reported as unused with no foreseeable use by the Department of Central Management Services.

• Requires state agencies to submit Annual Real Property Utilization Reports by July 31 each year, with the Administrator furnishing copies to the General Assembly by October 31 indexed by legislative district.

• Allows state agencies to request transfer of surplus property within 60 days of notification, with the Administrator determining which requests serve the state's best interests.

• Requires approval by the General Assembly by statute for any transfer of surplus real property valued at $1,000,000 or more to non-state entities, regardless of the transfer amount.

• Directs that proceeds from surplus property sales be deposited in the General Revenue Fund, with exceptions for special funds that originally funded acquisition and for closed mental health and developmental disabilities facilities whose proceeds fund specific Medicaid trust funds.
