IL HB1145

Amends the Mental Health and Developmental Disabilities Confidentiality Act (740 ILCS 110/10) to add a new exception allowing disclosure of mental health records in child custody and visitation proceedings.

Records and communications may be disclosed in custody or visitation proceedings only if the court finds, after in camera examination, that the records are relevant to the safety or health of the child and are admissible.

Maintains existing protections by requiring court review before disclosure and allowing parties to request in camera review of records before they are released.

Creates a specific exception to therapist-patient privilege for child custody and visitation cases while preserving confidentiality protections in other types of proceedings.
