HB1202 Summary

• Amends the New Vehicle Buyer Protection Act to extend protections to buyers of new motorized wheelchairs, including the right to replacement or refund if the seller cannot repair warranty defects after reasonable attempts.

• Establishes that a "reasonable number of attempts" to repair is presumed when the same defect has been repaired 4 or more times during the statutory warranty period, or when the wheelchair has been out of service for 30 or more business days for repairs.

• Defines the statutory warranty period for motorized wheelchairs as the period of the lease or 12,000 miles, whichever occurs first after delivery to the consumer.

• Specifies that refunds must be paid to the consumer and to any lien holders, including the medical assistance program administrator, Medicare program administrator, or private insurers.

• Applies the Act to motorized wheelchairs with model year 2012 and thereafter, and takes effect immediately upon becoming law.
