IL HB1236

Requires the Department of Corrections to conduct a mental health evaluation by a psychiatrist or clinical psychologist before releasing any committed person from a DOC institution or facility.

If the evaluation determines a committed person is severely or profoundly mentally retarded and not functional, the person must be referred to the Department of Human Services.

Persons determined to be severely or profoundly mentally retarded and not functional can only be released directly into the Department of Human Services' care or to a family member or other person capable of providing care.
