First conviction for violating Sections 4-7 of the Litter Control Act is a Class B misdemeanor; second conviction is a Class A misdemeanor; third or subsequent conviction is a Class 4 felony.

Courts may order convicted persons to remove and dispose of litter, employ supervisory bailiffs, and tax supervision costs against the offender.

Individuals convicted of littering on public highways may be required to maintain litter control for 30 days over a designated portion of that highway.

A mandatory minimum fine of $100 must be imposed against any person convicted of violating Section 5 of the Litter Control Act.

These penalties are in addition to any other penalties, rights, remedies, or liabilities imposed under existing law.
