HB1635 Summary

• Extends the Real Estate Appraiser Licensing Act of 2002 from January 1, 2012 to January 1, 2022 by amending the Regulatory Sunset Act.

• Requires licensees to retain records as required by the most recent version of USPAP (Uniform Standards of Professional Appraisal Practice) and as further defined by rule, replacing previous specific retention requirements.

• Adds new confidentiality protections allowing the Department to disclose examination and investigation information only to law enforcement officials, other regulatory agencies with appropriate interest, or parties with a lawful subpoena; formal complaints and orders issued by the Department remain public records.

• Authorizes the Coordinator of Real Estate Appraisal to investigate complaints, interview witnesses and involved parties, and make recommendations regarding findings of fact.

• Defines "address of record" as the designated address maintained by the Department and requires applicants and licensees to notify the Department of address changes through the Department's website or by direct contact.
