HB3166 - Health Courts Act

• Creates the Illinois Health Courts Commission with 10 members (3 hospital representatives, 3 physician representatives, 4 citizen representatives) appointed by the Governor with Senate consent.

• Establishes an alternative dispute resolution process requiring health care providers to notify patients within 30 days of adverse events and make compensability determinations within 60 days of claim submission.

• Requires providers to offer compensation based on a Commission-created damages schedule for compensable events, with patients able to appeal denials to an arbitrator for de novo review.

• Arbitrators must meet qualifications (licensed attorney in Illinois, 3+ years at Workers' Compensation Commission, or 4+ years labor relations experience) and undergo formal training in liability law, medical topics, and evidence procedures.

• Commission must maintain searchable database of arbitrator decisions with identifying information redacted and issue annual reports to the Governor on June 30.
