IL HB3284

Adds new subsection (a-7) creating a separate offense for indecent solicitation of a child when a person age 17+ uses computer or online services to violate subsection (a) while misrepresenting their age to the child.

Establishes enhanced penalties for the new (a-7) offense: Class X felony if the act would constitute predatory criminal sexual assault of a child or aggravated criminal sexual assault; Class 1 felony for criminal sexual assault; Class 2 felony for aggravated criminal sexual abuse.

Maintains existing penalties for subsection (a) offenses (Class 1, 2, or 3 felonies depending on underlying offense) and subsection (a-5) Internet-based sexual discussion offense (Class 4 felony).

Clarifies that it is not a defense to subsection (a-5) charges that the person did not solicit the child to perform sexual conduct with the defendant specifically.

Adds definitions for "computer," "on-line," and "Internet" by reference to Section 16J-5 of the Criminal Code.
