HB3285 Summary

• Amends Section 11-20.1 of the Criminal Code of 1961 regarding child pornography offenses involving minors under 18 and severely or profoundly mentally retarded persons.

• Adds new offense (paragraph 8) making it a Class X felony to knowingly film, videotape, photograph, or depict any actual or simulated act of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse involving children, with sentences of 9-40 years imprisonment.

• Establishes that violations involving a child engaged in sexual penetration or bound in sadistic/masochistic abuse constitute crimes of violence.

• Adds liability exemption (subsection 1.5) protecting telecommunications carriers, commercial mobile service providers, and Internet service providers from prosecution except for willful and wanton misconduct related to transmission or storage of illegal materials.

• Requires courts to seal all sexually explicit evidence depicting victims or witnesses upon case conclusion, with unsealing only permitted for good cause shown upon motion.
