Retired teachers receiving a retirement annuity (excluding disability annuities) may accept employment as teachers without losing retirement status if employment is not in the school year of termination and does not exceed 100 paid days or 500 paid hours annually (120 days or 600 hours from July 1, 2001 through June 30, 2011).

A day of employment is counted as 5 hours when work is split between daily and hourly compensation.

Subsection (a) does not apply to annuitants returning to teaching under the program established in Section 16-150.1.

Multiple retired annuitants cannot jointly fill a single full-time teaching position without impairing their retirement status; school districts seeking to address teacher shortages through multiple part-time retirees must apply for an exemption under Section 16-150.1 instead.

This Act takes effect upon becoming law.
