HB3420 Summary

• Department of Healthcare and Family Services must provide horse racing and riverboat gambling licensees access to the State Case Registry to identify individuals delinquent in child support, including their identifying information and delinquency amount.

• Licensees must withhold delinquent child support from cash winnings of $1,000 or more paid to individuals identified as delinquent, and may retain an administrative fee of the lesser of 3% of the amount withheld or $100.

• Licensees must transmit withheld amounts to the Department within 7 business days and issue the obligor a receipt detailing the total amount withheld for child support and the administrative fee.

• Department must notify the obligor of the intended offset and hold the withheld amount for 10 business days before applying it to delinquent child support obligations.

• Withheld child support and administrative fees have priority over all other claims on winnings except federal and state tax withholding; licensees are granted immunity from civil or criminal liability for complying with these provisions.
