Changes HIV testing for incarcerated persons from optional ("entitled to testing") to mandatory ("shall be tested"), with the ability to opt out under Department rules.

Requires test results to be kept confidential and makes implementation subject to appropriation.

Provides that incarcerated persons are entitled to counseling related to HIV testing at no cost, and those testing positive receive medical care, counseling, and referrals to support services while incarcerated.

Moves HIV testing counseling requirements from subsection (d-5) to new subsection (d-6) and clarifies that implementation is subject to appropriation.
