HB3884 - Overhead Utility Facilities Damage Prevention Act

• Permits planting of trees with mature height under 25 feet within 20 feet of electric utility poles or overhead conductors rated 100 kilovolts or less, based on the "Manual of Woody Landscape Plants" by Michael Dirr.

• Prohibits planting of trees exceeding 25 feet in mature height within 20 lateral feet of utility infrastructure; non-compliant vegetation becomes subject to removal by electric utilities.

• Requires electric utilities to provide educational material on websites and place notices in billing statements (May and September) and newspapers informing the public of tree-planting restrictions.

• Directs the Illinois Commerce Commission to establish removal procedures within 180 days for non-approved vegetation planted before and after the Act's effective date, including removal without replacement requirements.

• Makes it unlawful to interfere with electric utilities and their contractors while performing vegetation management and removal activities; permits utilities to assess charges for removing non-approved vegetation planted after the Act takes effect.
