HB4005 Summary

• Amends Section 11-9.3 of the Criminal Code of 1961 to establish comprehensive restrictions on child sex offenders' presence and activities in locations where minors are present.

• Prohibits child sex offenders from being present in school buildings, school property, school vehicles, public parks, and within 500 feet of schools, parks, playgrounds, and child care facilities, with limited exceptions for parents/guardians attending school conferences with prior notification.

• Forbids child sex offenders from loitering within 500 feet of schools or public parks when minors are present, residing within 500 feet of schools or facilities serving minors, and communicating via internet or digital media with persons under 18 (except their own children).

• Prohibits child sex offenders from operating, managing, or being employed at facilities providing programs or services for minors, offering programs to minors in residences, operating ice cream trucks or emergency vehicles, and renting residential units to families with children.

• Creates new offense of knowingly transporting a non-familial minor without parental consent as a Class A misdemeanor, while other violations are Class 4 felonies.
