Amends the Illinois Public Labor Relations Act to expand the definition of "public employee" to include home care and home health workers who function as personal care attendants, personal assistants, and individual maintenance home health workers under the Home Services Program, effective with the 97th General Assembly.

Designates the State of Illinois as the employer of home care and home health workers under the Home Services Program for purposes of collective bargaining, regardless of whether services are provided through direct fee-for-service arrangements, managed care organizations, or other intermediaries.

Limits collective bargaining for home care and home health workers to terms and conditions of employment under the State's control, consistent with prior amendments regarding personal care attendants and child care home providers.

Clarifies that home care and home health workers are not considered public employees for purposes of vicarious liability in tort, statutory retirement benefits, or health insurance benefits under the State Employees Group Insurance Act of 1971.

Amends the Disabled Persons Rehabilitation Act to expand language regarding home care and home health worker coverage under the Home Services Program and excludes workers in the Home Based Support Services Program in the Department of Human Services Division of Developmental Disabilities.
