Department of Children and Family Services must file a petition in circuit court requesting appointment of the Office of State Guardian as guardian for persons with intellectual or developmental disabilities who reach age 21 while receiving child residential services in Department-licensed facilities.

If appointed by the court, the State Guardian serves as guardian of the person from the date they turn 21 until the day before their 22nd birthday.

Department must file its guardianship petition in a timely manner to ensure that guardianship, if granted, commences on the person's 21st birthday.

The bill takes effect immediately upon becoming law.
