HB4665 - Radon Resistant Construction Act

• All new residential construction in Illinois must include passive radon resistant construction, defined as installation of passive new construction pipes that rely on natural convective air flow from below the foundation to above the roof.

• The Illinois Emergency Management Agency has primary responsibility for coordination, oversight, and implementation of radon-related matters in dwellings and buildings, and must promulgate necessary rules for administration.

• Active mitigation systems and radon vent fan installations must be performed only by licensed radon contractors, while residential building contractors may install passive radon resistant construction during new home construction.

• Local governmental units may adopt ordinances regulating radon resistant construction that are at least as stringent as state rules, or adopt state rules by reference.

• Act establishes a Task Force on Radon-Resistant Building Codes with representatives from home builders, inspectors, realtors, health organizations, and legislative leadership to recommend building code standards; effective date is June 1, 2013.
