IL HB4995

Amends the Humane Care for Animals Act to elevate penalties for harming police animals, service animals, and search and rescue dogs from a Class A misdemeanor to a Class 4 felony for first offense, and Class 3 felony for second or subsequent offenses.

Adds process servers (authorized under Section 2-202 of the Code of Civil Procedure and special process servers appointed by circuit court) as protected persons under aggravated assault statutes, making assault against them a Class 4 felony.

Expands aggravated assault protections to include county juvenile detention center employees who provide direct supervision of residents, classifying assault against them as a Class 4 felony.

Replaces terminology "mentally retarded" with "intellectually disabled" throughout aggravated battery provisions relating to crimes against children and severely or profoundly disabled persons.

Creates new Class 1 felony provisions for aggravated battery involving intentional torture with extreme physical pain infliction, and for strangulation causing great bodily harm with enhanced penalties when dangerous instruments or prior convictions are involved.
