Exempts retired teachers who return to employment as substitute teachers from criminal history records checks, provided they previously submitted to a fingerprint-based criminal history records check as a condition of their original employment with the same school district.

Allows school districts to optionally require retired teachers seeking substitute positions to submit to Federal Bureau of Investigation fingerprint-based criminal history records checks and checks of the Statewide Sex Offender Database and Statewide Murderer and Violent Offender Against Youth Database.

Applies the exemption to individuals who submitted to a fingerprint-based criminal history records check as a condition of employment and subsequently retired from that school district before seeking substitute teacher positions.

Amends both Section 10-21.9 and Section 34-18.5 of the School Code to add the new subsection (d-5) establishing these exemptions and optional check procedures.
