Effective July 1, 2012, the Department of Healthcare and Family Services shall implement an evidence-based nursing facility reimbursement methodology based on Resource Utilization Group (RUGs) methodology incorporating patient acuity, health outcomes, and quality measures.

Reduces the long-term care provider assessment from $6.07 to $2.04 per licensed bed day (rather than occupied bed day), effective July 1, 2011.

Assessment amounts exceeding $1.50 per licensed bed day are contingent on federal approval and cannot be collected until the Department notifies providers in writing that the assessment is permissible under Title XIX and necessary waivers have been granted.

Assessment shall cease and remaining funds refunded to providers if General Revenue Fund resources for long-term care fall below fiscal year 2012 levels, payment methodology rates are reduced, or new reimbursement methodology is underfunded.

Repeals the Nursing Home Licensing Fee Article and takes effect immediately upon enactment.
