HB5246 Summary

• Amends Section 1A-4 of the School Code to make a technical change regarding the powers and duties of the State Board of Education.

• State Board of Education shall appoint a State Superintendent of Education under a performance-based contract linked to statewide student performance and academic improvement.

• State Superintendent contracts must expire no later than February 1, 2007, and subsequent contracts must expire every 4 years thereafter, with the Superintendent serving until a successor is appointed.

• State Board cannot delegate certain powers to the State Superintendent, including the authority to nonrecognize school districts, withhold state payments as penalties, or make final contested case decisions unless otherwise provided by law.

• Joint Education Committee established by the Board is abolished effective on the operative date of the 95th General Assembly amendatory act.
