HB5252 Summary

• Removes requirement that counties retain $1 of each $10 Rental Housing Support Program surcharge in their general revenue fund and instead directs all collected surcharges to the Department of Revenue for deposit into the Rental Housing Support Program Fund.

• Changes recorder submission requirement from submitting $9 of each surcharge to submitting the full surcharge amount collected in the preceding month to the Department of Revenue.

• Adds a severability clause to the Rental Housing Support Program Act to preserve the validity of remaining provisions if any part is ruled invalid.

• Applies to both standard class counties under Section 3-5018 and third class counties under Section 4-12002 of the Counties Code.

• Takes effect immediately upon becoming law.
