HB5259 - Consumer Contract Right to Know Act

• Creates the Consumer Contract Right to Know Act requiring businesses that use standard form consumer contracts to provide consumers access to these contracts before sale to enable comparison shopping.

• Covered entities must make contracts reasonably accessible through website posting, availability at places of business, or provision upon request via telephone, fax, email, letter, or other standard communication methods.

• Prohibits conditioning consumer access to contracts on sale, application, or consent, and prohibits contracts that waive consumer rights under this Act.

• Authorizes the Illinois Attorney General to enforce the Act with a 5-year statute of limitations for violations.

• Establishes penalties for knowing violations including actual damages, statutory damages up to $1,000 or the contract amount (whichever is less), court costs, attorney's fees, and equitable relief; applies to contracts initiated after the effective date.
