IL HB5279

Amends Section 31-4 of the Criminal Code of 1961 regarding the offense of obstructing justice.

Adds new subsection (b) clarifying that it is not a required element of the offense that the defendant's conduct actually or materially prevents apprehension or obstructs prosecution or defense of any person.

Maintains existing definitions of obstructing justice conduct: destroying or concealing evidence, inducing witnesses to leave the state, or leaving the state while possessing material knowledge.

Preserves sentencing provisions making obstructing justice a Class 4 felony, or a Class 3 felony when committed in furtherance of gang-related activity.
