HB5281 Summary

• Amends the AIDS Confidentiality Act to revise definitions of "health care facility" (now "health facility"), and adds new definitions for "emergency responder" and "police officer"

• Allows informed consent for HIV testing to be provided in writing, verbally, or by video/electronic means, and permits combining HIV testing consent with other medical care forms provided subjects can opt out clearly

• Permits testing without informed consent when health care providers or emergency responders have accidental direct skin or mucous membrane contact with blood or bodily fluids that may transmit HIV, and requires counseling if results are positive

• Expands the list of communicable diseases in the Communicable Disease Prevention Act to include hepatitis B, hepatitis C, anthrax, rabies, HIV, tuberculosis, measles, mumps, pertussis, SARS-CoV, and other specified diseases

• Repeals Section 2a of the Communicable Disease Prevention Act, which previously required notice to school principals regarding children with AIDS or HIV
