HB5305 Summary

• Amends the return of bail deposits by requiring courts to return bail after deducting 10% as bail bond costs and any fees, fines, costs, and assessments, rather than returning 90% and retaining 10% as bail bond costs.

• Eliminates the provision that allowed bail deposit balances to be automatically applied to payment of fines and court costs after judgment; bail can still be used for other defendant financial obligations at court discretion.

• Maintains minimum bail bond cost retention of $5 and establishes different rules for counties with populations of 3,000,000 or more versus smaller counties regarding use of bail deposits across multiple cases.

• Allows defendants to request that remaining bail deposits be paid to their attorney of record.

• Becomes effective January 1, 2013.
