HB5336 - OSHA Program Reorganization Act

• Transfers all powers, duties, rights, and responsibilities of the Illinois Onsite Safety and Health Consultation Program from the Department of Commerce and Economic Opportunity to the Department of Labor effective July 1, 2012.

• Department of Labor becomes the successor agency and provides all management, staff support, and resources necessary to operate the transferred OSHA Program.

• Employees performing OSHA Program functions retain their employment status, rights, and benefits under the Personnel Code, collective bargaining agreements, and pension/retirement plans without disruption.

• All books, records, documents, contracts, property, and pending business related to the OSHA Program transfer to the Department of Labor, along with all unexpended appropriations and funds for the program.

• Department of Labor assumes responsibility for providing confidential on-site safety and health consultations and recommendations regarding compliance with federal Occupational Safety and Health Administration requirements, replacing the Department of Commerce and Economic Opportunity's prior role.
