Local liquor control commissions shall issue smoking licenses to eligible establishments including bars (with less than 10% food revenue), gambling venues, adult entertainment venues, private clubs (with three-fifths member approval), and tobacco convention/exposition venues.

Eligible establishments must disclose smoking permission to employees, obtain employee acknowledgment, and install an air filtration system meeting International Mechanical Code standards to qualify for a smoking license.

Smoking is authorized in establishments that obtain a smoking license from the local liquor control commission, requiring prominent signage to notify the public of the smoking designation.

Home rule units are prohibited from issuing smoking licenses in a manner inconsistent with state law standards, limiting concurrent exercise of home rule powers under the Illinois Constitution.

The Act takes effect immediately upon becoming law.
